EXCEPT AS EXPRESSLY STATED IN THE VIRCA EARLY ACCESS TERMS, THE VIRCA SERVICE IS PROVIDED BY WHATAP GLOBAL INC. ("VIRCA," "WE," "US") ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VIRCA DISCLAIMS ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND SECURITY.

Virca is early-access software, provided at no charge. It may change, break, or be withdrawn at any time.

2.1 Recommend, approve, act. Virca runs on a recommend → approve → act model. It drafts an action; the action executes only inside the set you have reviewed and approved, or after an approval you grant at the moment it runs.

When your approval happens. No action can execute until you have approved it in advance, at the time it is drafted and registered. Before an action becomes capable of executing, the Service shows you the commands it contains and the hosts it is assigned to, and you confirm it. Where you then bind that action to a rule, later runs of that action inside the scope you assigned proceed without a further approval — that is the behaviour you configured, not an exception to it. Where you instead marked it as requiring approval, that confirmation makes the action available but authorizes no execution; each run additionally requires your approval at the time it runs. Anything outside your approved set — a different command, or the same command against a host you did not assign — stops and asks first.

Approval given in advance is approval. It is not unattended operation. You remain responsible for reviewing and maintaining what you approved, and the execution record exists for that purpose. Virca does not make unilateral decisions about your infrastructure, and provides no mode in which it selects and executes an action outside your approved set on its own determination.

2.2 No guarantee of accuracy. AI-generated drafts, analyses and suggested remediation steps are produced algorithmically from data the Virca Agent can see. They may not reflect the complete state of your environment — network conditions, dependencies outside the Agent's visibility, or changes made concurrently through other tools. They may be incomplete, incorrect, or unsuitable for your environment. Virca does not warrant that an AI-generated recommendation is accurate, complete or current; that an executed action will resolve the underlying problem; that any check the Service runs after an action will correctly determine that a condition is resolved, or that a resolved condition will not recur; or that an action inside your approved set will not have unintended effects on your systems, data or services. Verify independently before you widen your approved set, or before you allow a command with significant system impact to run without a person.

Evidence and diagnosis. Where the Service collects metrics, snapshots or other diagnostic data at the moment a condition is detected and keeps them with the execution record, it does so to support your review. That evidence may be incomplete, and the Service does not determine root cause. Conclusions drawn from it — including root-cause findings and any capacity, configuration or architectural decision — remain yours.

2.3 Your responsibility for what you approved. You are solely responsible for reviewing and approving the action set before it is armed; for judging whether those actions suit your environment and risk tolerance; for the risk level you declare on any command you add yourself; for reviewing the execution record; and for the outcome of anything you approved, whether it ran automatically or after your approval at the time.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRCA IS NOT LIABLE FOR ANY LOSS, DAMAGE OR DISRUPTION ARISING FROM THE EXECUTION OF COMMANDS YOU APPROVED, OR THAT FALL INSIDE THE BOUNDARY YOU CONFIGURED, except to the extent it is finally determined to have resulted from Virca's gross negligence or willful misconduct.

Virca is delivered over the internet. We do not guarantee uninterrupted or error-free operation. Outages, maintenance, degraded performance and connectivity interruptions may occur, and may affect the Agent's ability to collect data, run actions, or deliver notifications. There is no service-level commitment during early access. While the Service is interrupted, detection, automated response and notification may be delayed or unavailable.

You decide what you keep alongside it. The Service detects the conditions covered by the rules you configure. It does not detect every possible failure — and a condition that produces no data at all, including a host that stops reporting altogether, may never raise an event. Keep whatever independent monitoring, alerting, backup and incident-response procedures you need in order to catch what the Service does not, and to cover any period when it is interrupted, degraded, or unable to reach your hosts.

The Virca Agent is software installed on hosts you control — cloud VMs and bare metal. By installing and running it you acknowledge that it collects infrastructure metrics, logs and performance data and sends them to Virca over a connection the Agent opens outbound, and that Virca processes that data to provide the Service and may derive aggregated, de-identified data from it; that it is installed with administrative privileges and executes approved commands with those privileges, only against the hosts you assigned an action to, and keeping those assignments accurate is your responsibility; that credentials the Agent uses to execute commands stay on your hosts and are not stored on Virca's servers, and issuing, scoping, securing and rotating them is your responsibility; that installing and configuring the Agent is your responsibility; that validating that the commands in your approved set behave as expected outside production, before you let them run in production, is your responsibility; and that the security of the host, its operating system and its network remains yours.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRCA IS NOT LIABLE FOR UNAUTHORIZED ACCESS TO, OR COMPROMISE OF, YOUR SYSTEMS THROUGH VECTORS OUTSIDE THE AGENT'S CONTROL.

Team chat. The Service can send notifications and approval requests to third-party chat platforms you configure. We are not responsible for their availability, accuracy or security, or for a notification that fails to arrive because of them.

Third-party AI clients. The Service exposes a Model Context Protocol ("MCP") interface you may connect to an AI client of your choosing. As between you and Virca, any request that reaches the Service through that interface using credentials issued under your account is your request. Virca does not control, and is not responsible for, that client, the model behind it, the tokens you issue it, who can use it, or any content it acts on — including instructions embedded in data it reads. Connecting it and controlling access to it are yours.

AI inference. AI processing in Virca runs on a third-party inference service identified in the Privacy Policy.

Virca works alongside your operations and engineering team. It does not replace the judgment of qualified engineers or operators. Do not configure it as your only safeguard against system failure, data loss, a security incident or an outage. Decisions about production infrastructure should involve human review — particularly for anything irreversible or high-impact. The Service is not designed or licensed for high-risk use, as described in the Virca Early Access Terms section 7.

Your use of the Service is subject to the limitation of liability and the indemnity in the Virca Early Access Terms sections 10 and 11, incorporated here by reference. Nothing in this Disclaimer creates liability beyond what those terms state, or limits any right they give you.

This Disclaimer is governed by the laws of the State of California, United States. Disputes are resolved as described in the Virca Terms of Use section 9. We may update this Disclaimer; the current version is the one posted here, and the date above says when it last changed. Questions: ask@virca.ai.
